Committed to gain your trust, NOVA has developed this Privacy Policy (hereinafter referred to as the “Policy”) to highlight our commitment, integrity, transparency, and security in handling and protecting your Personal Information

• “Privacy Law(s)” means any Applicable Laws relating to the protection of privacy including, without limitation, the Freedom of Information and Protection of Privacy Act (Ontario) and the Personal Information Protection and Electronic Documents Act (Canada).

3. SCOPE AND COMMITMENT TO THE PROTECTION OF PRIVACY

Protecting the privacy and confidentiality of your personal information has always been the fundamental principle in NOVA’s relationship with its Customers. This Policy, namely: (i) provides practical tips to help guard against fraud and how to secure your computer, protect your personal information, and ensure the confidentiality and privacy of the collected information (hereinafter referred to as the “Information”); (ii) describes how and when NOVA collects, uses, and shares your Information when accessing this Website; and (iii) applies to personal information collected by NOVA and its subsidiaries, related entities, and affiliates, in the operations of any physical location in Canada and of its Canadian websites and domains, including, but not limited to, this Website.

This Policy does not apply to, namely: (i) any operations outside of Canada which may be subject to its own privacy statements and policies; (ii) customers’ interactions with third parties or such third parties’ websites despite being linked to or accessible from this Website or that are operated by unaffiliated parties, even though their website may contain references to NOVA; and (iii) NOVA employment related records.

All employees and those working on behalf of NOVA are responsible to follow this Policy. NOVA has a Privacy Officer who is also responsible for overseeing NOVA’s compliance with this Policy as further identified below. When you create, sign up or reconfigure your NOVA account, and when browsing this Website, you are presumed to have voluntarily and irrevocably provided your implied or express consent and authorization to collect, use, transfer, manipulate, store, disclose, and other use of your Information in accordance with and as described herein.

When providing the above Information, and notwithstanding anything to the contrary in this Policy, the collected Information will serve us to, namely: (i) administer this Website, NOVA business, and affiliated businesses, including the management of our Customers accounts to accurately record and update your information; (ii) generate statistical reports on the number of Customers, number of visits to this Website, demographics or Customers’ consumer habits; (iii) manage and process our Customers’ purchase orders and other relevant information; (iv) appropriately invoice our Customers ; (v) promote, communicate with, and enable our Customers to benefit from NOVA’s products, services, special offers, and promotions; (vi) understand and analyze Customers’ responses, needs, and preferences; (vii) develop, enhance, market and/or provide products and services to meet our Customers specific needs and expectations; and (viii) respond to inquiries.

NOVA also collects Information by automated means in accordance with Applicable Laws. When you browse this Website through a mobile, smartphone, tablet, or other similar device and applications available on the App Store, Google Play Store, etc….  NOVA may collect certain information by using cookies and other technologies. During your communication with our customer service centre, service desk, network ops centre or other support lines, NOVA may also collect audio, video, or electronic information and other recording of conversations with you which are used for quality control, training, security, and analytic purposes.

From time to time, Customers may be asked to provide additional Information. If you decline, it may affect your ability to browse this Website.

5. COLLECTED INFORMATION FROM OTHER SOURCES

NOVA may collect the same type of Information from subsidiaries, related entities, and affiliates and other acquired businesses, business partners, public sources, or other individuals.

7. SHARING OF INFORMATION

NOVA does not share your Information with any organization or individual other than our affiliated businesses, suppliers, and companies contracted to process and manage Customers transactions, research, analysis, communications, and the provision of various products and services to NOVA, such as installation, repair, warranty, processing and fulfillment, information technology, marketing, customer service, data analytics, research and enhancement, fraud prevention, background investigations, legal compliance, and risk management. These entities may need access to such Information in order to perform their services and functions in favour of NOVA, and in all cases, only to fulfill the specified purposes.

NOVA may also share your Information with unaffiliated entities only with your proper implied or express consent, and specifically to conduct our business with service providers and business partners, in accordance with legal data protection requirements.

When browsing this Website, NOVA may share your online activities, such as IP address, device ID, cookie ID with social media networks and platforms or online advertisers aimed at tailoring commercial advertisement.

Under certain circumstances, and only with your knowledge and/or consent or if required or permitted by Applicable Laws, NOVA may disclose your Information to a third party who may also use the Information for their own specific purposes. In the event of any business sales (shares sale, assets sale or a combination, reorganization, dissolution or liquidation), your Information may be assigned and transferred to the prospective purchaser or assignor but only to the extent your Information is necessary for such transaction subject to NOVA complying with all Applicable Laws.

8. RETAINING AND PROTECTING OF INFORMATION

NOVA will retain your Information for as long as necessary to process transactions, maintain appropriate financial and audit records, provide and improve our products and services, protect our legitimate business interests, and as required by Applicable Laws.

NOVA collects and stores your Information using reasonable safeguards and a combination of measures against accidental, unlawful or unauthorized loss, destruction, access, disclosure, or alteration, or any similar breaches, including encryption, firewalls, passwords, and antivirus software; and only for such Information under its legal control and for such purposes for which it is used and the format in which it is stored. For clarity, NOVA may store your Information either at its own facility or of those of its affiliate in Canada, the USA, or any other country and foreign Privacy Laws may be applicable.

NOVA developed internal policies and procedures defining the roles and responsibilities of its personnel regarding the handling of your Information and appointed a Privacy Officer responsible for NOVA’s compliance with applicable Privacy Laws.

Despite the above, NOVA cannot guarantee that this Website, systems or applications will be completely safe or secure from any unlawful attacks by third parties due to inherent nature the Internet.

9. DISCLOSURE PREFERENCES

You may withdraw your consent, subject to the legal or contractual restrictions and reasonable notice. However, such withdrawal may affect NOVA’s capability to provide you with products and services or to send you newsletters and latest offers by email.
